In order to participate in the Profane Test, you undertake the following duties and obligations:

 

You shall not (unless expressly authorized by INSANE):

 

1. Disclose any image, video or other kinds of records from the Profane Test to any third-party;

2. Disclose any aspect of your experience with the Profane Test to any third-party, including, but not limited to, personal comments and impressions;

3. Disclose or share any file from any part of the Profane Test (regardless of if it is an in-game file or not) to or with any third-party;

4. Stream to online platforms your experience (whether in-game or not) with the Profane Test;

5. Disobey any orders or instructions from INSANE regarding the Profane Test.

 

You also represent and warrant that:

 

1. Any and all aspects of your participation in the Profane Test are strictly confidential and shall not be disclosed whatsoever. In this sense, and for all purposes, this whole message is deemed as a non-disclosure agreement;

2. As a requirement to participate in the Profane Test, you adhered to the code of conduct for the Profane game and undertook to respect the basics of interpersonal relationships inside the game and its community forums, according to the best practices regarding online gaming and communities. Those basics include, but are not limited to, refraining from disseminating (or doing): (i) negative and toxic behavior, hate speech, spam, offensive and criminal acts and threats; (ii) improper or illegal content, such as pornographic, political or religious content; (iii) first or third-party advertising; (iv) practices directly or indirectly related to creating false accounts or using personal data which is not yours. 

 

Finally, by proceeding with the Profane Test, you understand that:

 

1. Monetary damages may not be an adequate remedy for any breach of this NDA by you and that we may, in addition to all other remedies available at law or in quantity, obtain immediate injuctive or other equitable relief, without the necessity of posting bond or other security, to remedy or prevent any breach or threatened breach of this NDA by you;

2. By participating in this test, you will be using a version of Profane which is not optimized and/or tested on different computers and systems, so it may require specific hardware characteristics (such as video card characteristics) to provide you a satisfactory experience. We are not responsible for any malfunction of your hardware and operating system software while you are participating in the Profane Test;

3. IN CASE YOU DISAGREE WITH ANY PROVISION HEREUNDER, YOU SHALL NOT PARTICIPATE IN THE PROFANE TEST, AS YOU WERE ONLY INVITED TO PARTICIPATE UNDER THE ASSUMPTION THAT THOSE PROVISIONS WOULD BE FULLY RESPECTED BY YOU;

4. YOU WILL BE PERMANENTLY BANISHED FROM THE PROFANE TEST AND THE GAME COMMUNITY IN CASE YOU BREACH ANY OF THE FOREGOING PROVISIONS.
